1. Acceptance of Terms

By accessing or using ScalePilot ("the Service"), operated by ScaleLogic, you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

ScalePilot is a multi-tenant business management platform that provides CRM, email marketing, social media management, content generation, and AI-powered business automation tools. The Service is available at scalepilothq.app.

3. Accounts

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account. You are responsible for all activity under your account. Notify us immediately of any unauthorized use.

4. Acceptable Use

You agree not to:

  • Send unsolicited or spam emails through the Service
  • Violate any applicable laws, including CAN-SPAM, GDPR, or other anti-spam and privacy regulations
  • Upload malicious content, viruses, or harmful code
  • Attempt to access other users' or organizations' data
  • Use the Service to harass, defame, or harm others
  • Reverse-engineer, decompile, or attempt to extract the source code of the Service
  • Use the AI features to generate illegal, harmful, or deceptive content
  • Exceed reasonable usage limits or abuse platform resources

5. Your Content

You retain ownership of all content you create, upload, or manage through the Service. By using the Service, you grant us a limited license to store, process, and transmit your content solely to provide the Service. We do not use your content for advertising or sell it to third parties.

6. Third-Party Integrations

The Service integrates with third-party platforms (social media, email providers, AI services). Your use of these integrations is also subject to the respective third party's terms of service. We are not responsible for third-party service availability, changes, or data handling.

7. Email and Communication Compliance

You are solely responsible for ensuring that your email campaigns and communications comply with all applicable laws, including CAN-SPAM, CASL, GDPR, and other regulations. All marketing emails sent through the Service must include a functioning unsubscribe mechanism and valid sender information.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted service. We may perform scheduled maintenance with advance notice when possible. We are not liable for downtime caused by factors beyond our control.

9. Limitation of Liability

To the maximum extent permitted by law, ScaleLogic shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

10. Termination

We may suspend or terminate your access to the Service at any time for violation of these terms, with or without notice. Upon termination, your right to use the Service ceases immediately. You may request export of your data within 30 days of termination.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the updated Terms. We will notify active users of material changes.

12. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved in the courts of the applicable jurisdiction.
